Ave Staffing SMS Terms and Conditions

1. Text Messaging Terms of Use
Ave Staffing provides text message updates to job seekers regarding application status, interview scheduling, and assignment details. By opting into a “Text Message Service” (as defined below) provided by Ave Staffing, you accept these Terms and Conditions and agree to receive recurring text messages to the phone number you provided to Ave Staffing or one of its affiliates. These messages may include updates, notifications, and alerts.
DEFINITIONS:
“Opting In,” “Opt In,” and “Opt-In” refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.
“Text Message Service” includes any arrangement or situation in which we send one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS, or successor protocols or technologies).
2. Opt-In Consent
In accordance with the 2024 TCPA guidelines, your participation in our SMS service requires explicit one-to-one consent. This means that by opting in, you consent to receive messages from Ave Staffing only. Consent cannot be shared with other companies or third-party entities without your direct approval.
To join our SMS program, you may opt in through the following methods, in compliance with the 2024 CTIA Guidelines:
Verbal Consent: Offer verbal consent by clearly agreeing to SMS participation after being read a compliant SMS consent disclosure.
By opting in, you acknowledge that your consent to receive SMS messages is not a condition of any purchase. You may receive informational messages as specified at the time of opt-in.
3. Message Frequency
This Text Messaging Service is for conversational person-to-person communication between you and our employees. We may send you an initial message providing details about the service. After that, the number of text messages you receive will vary depending on how you use our services and whether you take steps to generate more text messages from us (such as by sending a HELP request).
4. Opt-Out Process
If you no longer want to receive text messages, you may reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. As a person-to-person communication service, opt-out requests are specific to each conversation between you and one of our employees and their associated phone number. After unsubscribing, we may send you confirmation of your opt-out via text message. 5. Terms of Consent
By opting into this SMS program, you agree to receive text messages from Ave Staffing in compliance with the TCPA and the FCC’s 2024 guidelines. All messages will be logically and topically related to your interaction with our services and products.
6. Privacy Policy
We take your privacy seriously. We only use information you provide through this service to transmit your mobile messages and respond to you. This includes, but isn’t limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Nonetheless, we reserve the right always to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. By opting into our SMS services, you agree to our Privacy Policy (avestaffing.com/privacy-policy), which explains how we collect, use, and protect your personal information. Your phone number and interaction data will only be used for the purpose of delivering the SMS messages outlined in this agreement.
7. Message and Data Rates
We do not charge you for the messages you send and receive via this text message service. But message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider Ave Staffing is not responsible for any fees charged by your carrier for receiving or sending messages related to our service.
8. Record-Keeping and Compliance
We maintain detailed records of when and how you provided consent to receive SMS messages. This includes storing opt-in and opt-out dates and timestamps. These records are maintained in compliance with TCPA regulations and may be used to demonstrate proof of consent if required.
9. Changes to Terms and Conditions
Ave Staffing reserves the right to modify or change these Terms and Conditions at any time. Any significant updates will be communicated via SMS or through our website. By continuing to use our SMS services after any changes, you agree to the revised Terms and Conditions.
10. Disclaimers and Liability Limitations
Ave Staffing is not responsible for delayed or undelivered messages. Delivery of SMS messages is subject to effective transmission from your mobile carrier and network provider. We cannot guarantee that SMS services will always be available in all areas.
